Diese Regelungen konkretisieren die Haftung der A&D Holding UG (haftungsbeschränkt) („Auftragio") und ergänzen die AGB.
Auftragio ist reiner Vermittler und nicht Vertragspartei der über die Plattform geschlossenen Aufträge. Für Zustandekommen, Ausführung, Qualität, Termintreue, Mängelfreiheit, Gewährleistung und etwaige Schäden im Zusammenhang mit dem Auftrag haftet allein der ausführende Fachbetrieb gegenüber dem Kunden. Ansprüche hieraus sind unmittelbar zwischen Kunde und Betrieb geltend zu machen.
Auftragio übernimmt keine Gewähr für die Richtigkeit, Vollständigkeit oder Aktualität der von Nutzern eingestellten Angaben (z. B. Profile, Anfragen, Preise, Bewertungen) sowie für die fachliche Eignung, Zuverlässigkeit oder Bonität der Betriebe. Verifizierungen, Auszeichnungen („Gold-Status") und Bewertungen sind Qualitätssignale, jedoch keine Garantie.
Wir bemühen uns um eine möglichst unterbrechungsfreie Verfügbarkeit, schulden diese jedoch nicht. Wartungen, Störungen oder Weiterentwicklungen (insbesondere in der Beta-Phase) können zu vorübergehenden Einschränkungen führen. Ein Anspruch auf bestimmte Funktionen oder ständige Verfügbarkeit besteht nicht.
(1) Auftragio haftet unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, bei Vorsatz und grober Fahrlässigkeit, bei arglistig verschwiegenen Mängeln, im Rahmen einer übernommenen Garantie sowie nach dem Produkthaftungsgesetz.
(2) Bei einfacher (leichter) Fahrlässigkeit haftet Auftragio nur bei Verletzung einer wesentlichen Vertragspflicht (Kardinalpflicht), deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung der Nutzer regelmäßig vertrauen darf. In diesem Fall ist die Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt.
(3) Im Übrigen ist die Haftung – soweit gesetzlich zulässig – ausgeschlossen. Die vorstehenden Beschränkungen gelten auch zugunsten der gesetzlichen Vertreter und Erfüllungsgehilfen von Auftragio.
Für Inhalte, die Nutzer einstellen, und für externe Links übernehmen wir keine Verantwortung. Bei Kenntnis von Rechtsverletzungen entfernen wir die betreffenden Inhalte bzw. Links umgehend (vgl. §§ 7–10 DDG).
Wir treffen angemessene technische und organisatorische Maßnahmen. Für Schäden durch Datenverlust haftet Auftragio nach Maßgabe von § 4 und nur, soweit der Nutzer für eine zumutbare, regelmäßige Sicherung eigener Daten gesorgt hat (Mitverschulden).
Für Leistungsstörungen aufgrund höherer Gewalt (z. B. Ausfälle von Telekommunikations-/Hosting-Diensten, behördliche Anordnungen, Naturereignisse) haftet Auftragio nicht; entsprechende Zeiträume verlängern Leistungsfristen angemessen.
Allgemeine Hinweise auf der Plattform (z. B. zur steuerlichen Absetzbarkeit von Handwerkerleistungen nach § 35a EStG) sind unverbindliche Informationen und ersetzen keine individuelle Steuer- oder Rechtsberatung.

These provisions specify the liability of A&D Holding UG (haftungsbeschränkt) ("Auftragio") and supplement the GTC.
Auftragio is a pure intermediary and not a contracting party to the jobs concluded via the platform. The executing specialist business alone is liable to the customer for the conclusion, execution, quality, adherence to deadlines, freedom from defects, warranty and any damage in connection with the job. Claims arising from this must be asserted directly between the customer and the business.
Auftragio gives no warranty for the correctness, completeness or timeliness of the information posted by users (e.g. profiles, requests, prices, reviews) or for the professional suitability, reliability or creditworthiness of the businesses. Verifications, awards ("gold status") and reviews are quality signals but not a guarantee.
We endeavour to provide the most uninterrupted availability possible, but do not owe it. Maintenance, faults or further development (in particular during the beta phase) may lead to temporary restrictions. There is no claim to particular functions or constant availability.
(1) Auftragio is liable without limitation for damage arising from injury to life, body or health, in cases of intent and gross negligence, for fraudulently concealed defects, within the scope of a guarantee assumed, and under the Product Liability Act.
(2) In the case of simple (slight) negligence, Auftragio is only liable for the breach of a material contractual obligation (cardinal obligation), the fulfilment of which is what makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely. In this case, liability is limited to the foreseeable damage typical of the contract.
(3) Otherwise, liability is excluded to the extent permitted by law. The above limitations also apply in favour of Auftragio's legal representatives and vicarious agents.
We assume no responsibility for content posted by users and for external links. Upon becoming aware of legal violations, we remove the relevant content or links without delay (cf. §§ 7–10 DDG).
We take appropriate technical and organisational measures. Auftragio is liable for damage caused by data loss in accordance with § 4 and only insofar as the user has ensured a reasonable, regular backup of their own data (contributory negligence).
Auftragio is not liable for performance disruptions due to force majeure (e.g. failures of telecommunications/hosting services, official orders, natural events); corresponding periods reasonably extend performance deadlines.
General notices on the platform (e.g. on the tax deductibility of craft services under § 35a EStG) are non-binding information and do not replace individual tax or legal advice.

Auftragio jest wyłącznie pośrednikiem i nie jest stroną umów zawartych za pośrednictwem platformy. Za zawarcie, wykonanie, jakość, dotrzymanie terminów, brak wad, rękojmię oraz ewentualne szkody związane ze zleceniem odpowiada wyłącznie firma wykonawcza wobec klienta. Roszczenia z tego tytułu należy dochodzić bezpośrednio pomiędzy klientem a firmą.
Auftragio nie udziela gwarancji co do poprawności, kompletności ani aktualności informacji zamieszczanych przez użytkowników (np. profile, zapytania, ceny, oceny) ani co do przydatności zawodowej, rzetelności lub zdolności kredytowej firm. Weryfikacje, wyróżnienia („status złoty") i oceny są sygnałami jakości, lecz nie gwarancją.
Dokładamy starań o możliwie nieprzerwaną dostępność, nie jesteśmy jednak do niej zobowiązani. Prace konserwacyjne, awarie lub dalszy rozwój (w szczególności w fazie beta) mogą prowadzić do przejściowych ograniczeń. Nie przysługuje roszczenie o określone funkcje ani o stałą dostępność.
(1) Auftragio odpowiada bez ograniczeń za szkody wynikające z naruszenia życia, ciała lub zdrowia, w przypadku winy umyślnej i rażącego niedbalstwa, za podstępnie zatajone wady, w ramach udzielonej gwarancji oraz na podstawie ustawy o odpowiedzialności za produkt.
(2) W przypadku zwykłego (lekkiego) niedbalstwa Auftragio odpowiada wyłącznie za naruszenie istotnego obowiązku umownego (obowiązku kardynalnego), którego spełnienie w ogóle umożliwia prawidłowe wykonanie umowy i na którego przestrzeganie użytkownik może z reguły polegać. W takim przypadku odpowiedzialność jest ograniczona do typowej dla umowy, przewidywalnej szkody.
(3) W pozostałym zakresie odpowiedzialność jest wyłączona – o ile jest to prawnie dopuszczalne. Powyższe ograniczenia obowiązują również na korzyść ustawowych przedstawicieli i pomocników Auftragio.
Za treści zamieszczane przez użytkowników oraz za linki zewnętrzne nie ponosimy odpowiedzialności. Po powzięciu wiedzy o naruszeniach prawa niezwłocznie usuwamy dane treści lub linki (por. §§ 7–10 DDG).
Podejmujemy odpowiednie środki techniczne i organizacyjne. Za szkody spowodowane utratą danych Auftragio odpowiada zgodnie z § 4 i tylko w zakresie, w jakim użytkownik zadbał o rozsądne, regularne tworzenie kopii zapasowych własnych danych (przyczynienie się).
Za zakłócenia w świadczeniu usług spowodowane siłą wyższą (np. awarie usług telekomunikacyjnych/hostingowych, zarządzenia urzędowe, zdarzenia naturalne) Auftragio nie odpowiada; odpowiednie okresy w rozsądnym zakresie wydłużają terminy świadczenia.
Ogólne wskazówki na platformie (np. dotyczące możliwości odliczenia podatkowego usług rzemieślniczych zgodnie z § 35a EStG) są informacjami niewiążącymi i nie zastępują indywidualnego doradztwa podatkowego ani prawnego.
